The minutes of the June 25, 2000, annual meeting were recorded on 9/27/2000. That document outlines 2 changes to the covenants and 1 change to the by-laws. (1) Modifies Article II Item 7 to include the additional sentence: Owners who walk their dogs must carry some type of pooper scooper or other materials to remove the waste from the common areas and shall not permit animals to do their business on private property. This change is NOT noted in the copy of the covenants that I have. (2) Modifies Article VI Section 2 Item b Item 3 to replace the existing text with the following: Wooden wall surfaces of units shall be replaced as a result of normal aging or rot. Wood destroyed by termites, fire, or natural disasters are not the responsibility of the Association. Should the unit require more than five (5) sheets of plywood and/or more than one hundred (100) feet of trim, the Association shall provide the materials needed and the owner shall be responsible for the cost of labor. This change is NOT noted in the copy of the covenants that I have. (3) Modifies Article X Section 1 Item b to change the ten dollar ($10.00) penalty to twenty ($20.00) This change IS noted in the copy of the By-laws that I have.
A document was recorded on 8/3/2006 that outlines a change to covenants that passed at the June 25, 2006, annual meeting. Modifies Article III Section 2 to read as follows: Section 2. Voting Rights. All owners of property in the Forest Hills Townehouse Association shall be entitled to one (1) vote for each Unit owned up to five (5) units. This change IS noted in the copy of the covenants that I have.
2017 Changed and Restated Covenants Recorded 11/8/2017 Book 1604 Pages 125 - 127P
The document recorded on 11/8/2017 includes the full covenants document that I had plus the change that was passed at the June 25, 2017, annual meeting. Article VIII was added to the covenants stating that the association submits to the Georgia Property Owners Act.
June 25, 2017 Approved reducing the number of board members from to five (5). Covenants Article III Section 3 states that the Board of Directors shall consist of either eight (8) or nine (9) members depending on whether or not the Treasurer is a member of the Association. By-laws Article VII Section 1 states that the Board of Directors shall consist of nine (9) members. These documents have NOT been modified to reflect this change.
June 24, 2018 Approved restricting the rental of units and limiting the number of rental units to 0%. The covenants and by-laws have NOT been modified to reflect this change.
